LIMITED LIFETIME MANUFACTURER'S PRODUCT AND WORKMANSHIP WARRANTY
Roeland Home Improvers
manufacturer of the acrylic wall surrounds, shower floors/bases, replacement bathtubs, bath liners, shower liners and acrylic accessories (collectively referred to as "Product") warrants to any residential purchaser of the RHI Product ("Customer") that its Product will be free of material defects for as long as the residential Customer owns the real property ("Property") where the RHI
Product was installed. Customer may transfer this Warranty to a subsequent buyer of Customer's residence. ("Warranty Transfer")
A Warranty Transfer will only be effective if made within 2 years of the Product Installation and/or the Customer has not engaged in conduct that would void the Warranty. THIS WARRANTY EXCLUDES ANY WARRANTY FOR CLAIMS RELATING TO INSTALLATION/LABOR OF RHI PRODUCTS. THIS WARRANTY IS FOR PRODUCT DEFECTS ONLY. RHI DOES NOT
WARRANT ANY NON-RHI MANUFACTURED PRODUCTS SUCH AS FAUCETS, SHOWER HEADS, DOORS, GRAB RAILS,AND/OR STOPPERS.
RHI warrants that the surface of the Product will not materially fade, yellow, crack, bubble, or peel under normal use and when cared for under the guidelines set forth by RHI. This warranty expressly prohibits the use of unapproved cleaners, and expressly excludes damage resulting from the use of same. In addition, this warranty is void if damage is caused by contact with any of the following:
dyes, paints, inks, certain cosmetics, or cleaning agents, abrasive pads, pigments, certain foods, paint remover, fingernail polish, remover, solvents or other chemicals, cigarettes or other sources of extreme heat, or abuse of any kind whether intentional or unintentional. Additional exclusions include escutcheon plates, valve handles, hand-held shower head hoses and other materials
not manufactured by RHI (in which case the normal manufacturer's warranty of each product applies). In the event of a failure of the Product, as a result of a material effect to the Product that is not caused by the Customer, RHI reserves the right to partially repair, completely replace, or provide a full or partial refund, whichever RHI deems appropriate in its sole
discretion.
Customers may make a warranty claim in writing with the RHI Dealer with which Customer originally contracted with. Upon notice to RHI of any warranty claim, RHI will take steps to assess the claim, determine a course of action and effectuate repair or other remedy
under the terms of this warranty for covered Products. Any warranty work is subject to then current lead times and then current product availability. Should the RHI Dealer from which the Customer originally contracted for service is no longer in business, or
should the Customer not be able to satisfactorily resolve a warranty issue with the RHI Dealer, the Customer should make a warranty claim in writing with RHI at:

The invalidity of any provision of this warranty shall not invalidate the remaining provisions of this warranty.

ANY CLAIM FILED BY THE CUSTOMER TO ENFORCE THE TERMS AND CONDITIONS OF THIS WARRANTY SHALL BE FILED IN THE STATE OR FEDERAL COURTS LOCATED IN COOK COUNTY, ILLINOIS TO THE EXCLUSION OF ALL OTHER JURISDICTIONS. THIS WARRANTY IS IN LIEU OF ALL WARRANTIES, EXPRESSED OR IMPLIED, AND IS IN FACT THE ONLY WARRANTY OFFERED BY RHI. UNDER NO CIRCUMSTANCES WILL RHI BE LIABLE FOR INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, DAMAGE TO PERSONAL PROPERTY, LOST PROFITS, LEGAL SERVICES AND LEGAL FEES, AND/OR LOSS OF TIME OR TRAVEL UNDER THIS WARRANTY. THIS WARRANTY EXPRESSLY EXCLUDES LOSS OF VALUE, LOSS OF USE, STIGMA AND DIMINUTION IN VALUE RELATED TO ANY COVERED FAILURE CLAIMED UNDER THIS WARRANTY. IN NO WAY SHALL THE TOTAL LIABILITY OF RHI EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER FOR SERVICES PROVIDED AND/OR THE GOODS PURCHASED. THE CUSTOMER SPECIFICALLY WAIVES ALL IMPLIED WARRANTIES AND THE WARRANTY FOR FITNESS FOR A PARTICULAR PURPOSE AND/OR THE IMPLIED WARRANTY OF HABITABILITY. THIS WARRANTY GIVES THE CUSTOMER CERTAIN LEGAL RIGHTS. SOME STATES DO NOT ALLOW LIMITATIONS OF THE IMPLIED WARRANTIES OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. SUBJECT TO APPLICABLE LAWS THIS WARRANTY APPLIES TO ALL SUCH LIMITATIONS TO THE FULLEST EXTENT ALLOWED BY LAW. THE WARRANTY OBLIGATIONS OF RHI ARE VOID AND OF NO AFFECT IF THE CUSTOMER HAS FAILED TO PAY FOR ANY GOODS OR SERVICES. THIS WARRANTY ONLY EXTENDS TO THE PRODUCTS AS DEFINED HEREIN AND EXCLUDES ALL OTHER PRODUCTS, SERVICES OR LABOR THAT MAY HAVE BEEN PROVIDED TO YOU.

TERMS AND CONDITIONS

1. The Owners hereby covenant and represent that they are the Owners in fee simple of the property and improvements thereon located on front of this agreement and that they desire certain improvements to be made and are willing to pay for them. The Company relying upon such representations, agrees to furnish the materials and labor to do the work on the property and/or the improvements thereon as is specifically hereinafter set as industry standard.

2. Should the Company be authorized to obtain financing for the owner, said Company is further authorized to search the market for the competitive terms available for the owner. Normal installation time is 60 to 120 days, from completed bank documents.3. The parties to this contract are bound and governed by the laws of the State of New Jersey as they apply thereto.4. Workman's Compensation and Public Liability insurance is carried by the Company, and is applicable to the work to be performed under this contract. Work to be performed according to Company specification. The Company does not paint or stain. Debris from job will be removed unless noted on account.5. The Company hereby proposes to furnish labor and material to complete the work for the amount herein. Fulfillment of this order is contingent, however, upon strikes, fires, ability to obtain materials or other conditions beyond the control of the Company. The Company will furnish replacement parts, glass, siding or window units equal to or better than original if said products become unavailable.

6. The Owner understands that after owners custom-size windows, doors, deck roofing and/or siding is ordered from manufacturer / distributor for owner's property the full contract price will be due and payable in the event owners breach or default.

7. The Company is not responsible for conditions or circumstances beyond its control, including excessive condensation, moisture resulting from or due to pre-existing conditions, interior nail pops, wall decorations and any unseen wiring and plumbing in or on outside wall that is not properly shielded.

8. The Company is not responsible for natural defects which may occur in wood products.9. In the event that installation cannot be completed in full due to factory defects beyond the Company's control, the homeowner is entitled to hold back money only for the amount of work which is incomplete. Maximum 10% of entire agreement.10. You will be charged interest at a yearly rate of 18% on any remaining balance not paid within thirty (30) days from the date of completion.

11. If you fail to make any payments required under this contract, you will be in default. Upon default, you will pay the full amount due plus the contractor's cost of collections and reasonable attorneys fees.

12. The Company does not assume liability for any pre-existing conditions over which is has no control, such as, but not limited to, the misalignment of customer(s) present window or door frames, settlement of the building and condensation conditions.

13. ADDITIONAL WORK: The contract price stated herein includes only the items purchased, ANY additional work requested by the customer(s) shall be charged in addition hereto, provided, however, the Company shall advise the customer(s) of the additional charges prior to the commencement of additional work in writing.

14. The Company will provide service, without charge, up to one year from the date of installation in accordance with warranty from the manufacturer issued to the buyer as long as the customer/owner resides at the property where improvements were made. After one year from date of installation, a service charge will be assessed. Service shall be rendered by the Company between 9:00a.m. and 4:00p.m. on weekdays. Service requests not in accordance with warrant issues by the manufacturer shall be charged to customer(s) at the prevailing labor rates plus material.

15. Customer(s) acknowledge(s) that is has been represented to the customer(s) that customer(s) will receive manufacturer's warranty exact to the current exhibited specimen of the warranty after the completion of the job providing there is no default of any payment or installments that may be due. The customer(s) further acknowl-edge(s) that the Company has made no other warranties or representations with respect to this contact.

16. It is agreed that in no event shall the liability of the Company exceed the contract price.

17. In the event of dispute, buyer and seller agree to utilize the binding arbitration program set forth in the Better Business Bureau Care Program or the State of NJ's Alternative Dispute Resolution (ADR).

18. It is understood and agreed that no claim may be made against any warranty and no obligations to make any repair for such warranty will be made until the full indebtedness to Roeland Enterprises Inc. d/b/a Roeland Home Improvers is paid by the homeowner.

GENERAL CLEANING INSTRUCTIONS: FOR NORMAL EVERYDAY CLEANING, USE CLEANER WITH A SOFT WASHCLOTH AND ALWAYS RINSETHOROUGHLY WITH WARM WATER AFTER CLEANING. A SQUEEGEE IS RECOMMENDED TO REMOVE EXCESS WATER FROM WALLS AND SHOWERDOORS.

RECOMMENDED CLEANERS: USE ONLY PRODUCTS WHOSE LABELS STATE THAT THEY ARE SAFE FOR ACRYLIC. ALWAYS TEST PRODUCT ON ASMALL AREA OF SKIRT BEFORE APPLYING TO COMPLETE BATH/SHOWER AREA.

DO NOT USE: SCRUBBING BUBBLES, ANY ABRASIVE CLEANERS, AJAX, COMET, TILEX, SOFT SCRUB, MR. CLEAN, NAIL POLISH REMOVER,SCOURING PADS, AMMONIA, TOUGH ACT AND POWDER OR CRYSTAL DRAIN CLEANERS. THE USE OF THESE CHEMICALS WILL CAUSE A DULLFINISH. IF TILE IS USED, ROELAND USES A "PRO SEAL TILE GROUT" AND OWNER UNDERSTANDS AND AGREES TO RE-SEAL TILE GROUTEVERY YEAR AS RECOMMENDED BY GROUT MANUFACTURER.OWNER PURCHASED ITEMS: ANY and all owner provided items such as Lights, Vanities, Cabinets, Sinks, Mirrors as well as Accessories must be fully opened and inspected prior to scheduling of work. If not opened and products are found to be damaged and a return trip is needed, an additional $275 per man (based on items) will be paid prior to our return.1. Time Delivery of Installation: Customer understands that any delivery or installation date is merely Company's best estimate of when performance will begin, and that performance is subject to delays example delays such as supply chain issues, Covid related work stoppage, and also customers delays in ordering products. Company's failure to meet a given delivery or installation date shall not be a breach of the Agreement entered into by and between Company and the Customer, and Company shall not be liable to Customer for any delay in Company's performance under the Agreement.2. Installation Days: Seller will make every effort to complete your installation in the time specified, when possible. If we cannot do so, we will not be liable for any reimbursement, discount, or any other type of compensation to you for claims of inconvenience or any other harm.

3. Existing Plumbing: We are not responsible for inspecting, servicing or modifying Buyer's existing plumbing. If, during the installation of RHI Elite Products, Seller determines that the existing plumbing is deficient or needs repair or adjustments, Seller will notify Buyer as soon as reasonably practical. If plumbing repairs or modifications are needed, Buyer may need to have the plumbing corrected before the Roeland installation can be completed. In addition, because the existing plumbing may be old, corroded, or in need of repair or replacement, we are not liable for any damage to plumbing below or behind the tub, including shut-off valves and drain shoes or old toilet lead bends.

4. Consumer/Buyer shall stay current with all payments. Roeland reserves the right to stop work if payments are not made in accordance with page one of contract. Buyer to hold harmless Roeland if they do not make payments accordingly for any reason(s).

5. Removal and Reinstallation of Existing Shower Doors: In the event that seller is asked to re-use any fixtures, doors or toilets, Seller will make every effort to successfully remove and reinstall existing shower doors if Buyer requests this service. However, if the items no longer fit properly when reinstalled or are damaged prior or in the removal process, we will not be liable for any reimbursement discount or any other type of compensation to Buyer.6. Wall Repair: If, during the installation phase, we are required to perform unforeseen repairs to your existing walls, an additional charge of $225 per wall will apply - this is for spackle work only, not for painting.7. Presence of Mold: Mold occurs naturally in almost all indoor environments. Mold spores enter homes through open doorways, windows and a variety of other ways. A Roeland Bath installation may include the removal of wet, loose, defective, discolored or odorous surfaces and the washing of remaining surfaces with a mold killing agent called Concrobium solution. Roeland is not responsible for any damages relating to mold.

8. Deposit Refunds: Because Roeland products are custom made, Seller cannot refund your deposit after the cancellation period has expired as set forth in Paragraph 3 as products are immediately allocated. Also, secondary payments must be made within 2 weeks of contract.

9. Payment in Full and Default: Payment in full is due immediately upon the completion of the installation. (Roeland is not responsible for "Customer-supplied" materials that arrive damaged/incorrect/or late and Roeland still requires payment in full unless Roeland supplied the late/damaged materials. If the work is completed, with exception of the shower doors, all balances must be paid, less $500). Any stop payment of check or credit card payment will result in a $75 service fee, plus any bank fees charged to Roeland. Default: If Customer defaults in the payment of any sums due Company or otherwise defaults in the performance of the terms and conditions of this Agreement, Company shall been titled to recover from Customer its reasonable attorneys' fees and costs in the enforcement of this Agreement.

10. Customer-Supplied Materials: Customer-supplied materials are not the industry standard that Roeland supplies or Roeland are trained in. This could result in potential installation problems and/or final overall appearance of Customer-supplied items. Roeland will not offer any refunds or discounts for anything pertaining to any aspect of Customer-supplied materials such as flooring, vanities, mirrors or lights.11. Permits and Fees. In the event that special or required permits, fees, bonds or other expenses of local municipalities are assessed to the work performed or being performed under this Agreement, it shall be the responsibility of the Buyer and will be added to the balance due under this Agreement.

Roeland Limited Lifetime Manufacturer's Product Warranty

Roeland products have been manufactured under the highest standards of quality and workmanship. Roeland products are backed by a Limited Lifetime Warranty as follows: Roeland warrants to the original consumer purchaser ("Customer") that the acrylic surface of its products will not materially fade, yellow, crack, bubble or peel under normal use so long as the Customer follows the care and maintenance guidelines set forth by Roeland. This warranty covers only those materials produced and sold by Roeland so long as those products are installed with the installation materials purchased from Roeland and will be void if any other installation materials are used. This warranty will be in effect for as long as the Customer owns their home (the "warranty period"). Roeland does not warrant any workmanship provided by the company installing Roeland products. Any warranty on workmanship must be provided by the company installing the Roeland product. This warranty is good for a period of 5 years on Roeland products installed in non-residential buildings (including hotels, industrial, commercial and business).Any claim under this warranty must be accompanied by proof of purchase (original sales receipt) from the original Customer. Roeland will allow the warranty to transfer one time to a new homeowner as long as it is within five years from the original invoice date. (All contract obligations and payments must have been paid in full.)In the event of a warranty claim, Roeland reserves the right to partially repair, completely replace or provide a full or partial refund, whichever Roeland deems appropriate in its discretion. This warranty is the only warranty in regard to products sold by Roeland Enterprises Inc. Roeland shall be responsible only for repairs, placements or a refund not to exceed the total amount paid for the product originally. Roeland will not be responsible for any incidental or consequential damages. This warranty is void if installation is not completed by a certified Roeland Installer & balance of agreement is not paid in full.
